Introduction
This document outlines the rights and responsibilities of end users (“you”) of Riskify, an AI-powered Safe Work Method Statement (SWMS) generator. It complements our Terms of Service and Privacy Policy, and should be read together with those agreements. Riskify’s platform is intended solely for lawful, professional use in creating SWMS compliant with Australian Work Health and Safety (WHS) law . By using Riskify, you agree to these responsibilities and are entitled to the rights described below. Nothing in this document limits any rights you have under Australian consumer protection laws that cannot be excluded by contract.
Your Rights as a User
Access to Services: You have the right to access and use the Riskify platform in accordance with our Terms of Service and applicable subscription (if any). Once you have subscribed and agreed to our terms, we will provide you with access to the SWMS generation services for your lawful, work-related purposes. You can expect the platform to be provided with reasonable care and skill, and we will use industry-standard measures to maintain service availability and security.
Ownership of Your Content: You retain ownership over all data and materials you input into Riskify, as well as the SWMS and other outputs generated from your input. As between you and Riskify, any content you provide (such as job details, site-specific information) remains your property, and any SWMS or documentation produced for you is owned by you . Riskify does not claim ownership of your work product. This means you are free to use, download, modify, and distribute the SWMS and outputs you generate for your legitimate business needs. (For clarity, Riskify retains all rights in the platform’s software, architecture, and templates – see Intellectual Propertybelow.)
Data Privacy and Security: You have the right to have your personal or company data handled in accordance with our Privacy Policy and applicable Australian privacy laws. We take reasonable steps to protect your information. Except for the automated processing needed to provide the service (and limited reviews in case of misuse flags), we do not monitor or share your project-specific inputs or generated SWMS with third parties without your permission, unless required by law. You can contact us to understand how your data is used and to exercise any data rights (such as access or deletion) as described in the Privacy Policy.
Intellectual Property (Platform vs. User Content): Riskify retains all intellectual property rights in the platform itself, including the web application, underlying AI models, software code, and any SWMS template structures or libraries we provide. Your subscription or use of Riskify grants you a limited licence to use the platform and those templates for the purpose of creating SWMS, but it does not transfer any ownership of the platform or its underlying content to you. Conversely, any content you create – your inputs and the outputs (the completed SWMS documents) – are yours to use. As between the parties, Riskify owns the service and infrastructure, and you own your specific project data and results . We will not use your SWMS content for our own purposes except as needed to operate or improve the service (and in those cases, in compliance with our Privacy Policy).
Use of Output: You have the right to use, copy, and share the SWMS and other documents generated through your lawful use of Riskify. This includes the right to print or export the SWMS for use at your worksites, to provide copies to employees, contractors, clients, or safety inspectors as required, and to adapt the content to fit your operational needs. Riskify imposes no claim or licence fee on your use of the generated safety documents – they are considered your own work product. However, you are responsible for ensuring that any distributed SWMS is accurate and suitable for the specific work and complies with applicable law (see Your Responsibilities below regarding verification).
Support and Communication: As a user, you have the right to reasonable support and communication from Riskify. You can contact us through the platform or official support channels for assistance, to report issues, or to provide feedback. We will endeavour to respond to user inquiries and resolve technical problems in a timely manner. You also have the right to be informed of important changes: if we make material changes to our Terms, Privacy Policy, or these Rights & Responsibilities, we will notify users via the platform or email as appropriate. We value user feedback and may use it to improve the service (any feedback you provide can be used by Riskify without obligation, though it’s not considered confidential).
Account Termination and Portability: You have the right to discontinue using Riskify at any time. If you decide to cancel your subscription or delete your account, you may do so pursuant to the process in our Terms of Service (for example, by providing any required notice or using the account settings). Upon termination or cancellation, you retain the rights to any SWMS documents you have already generated. We recommend you download or export any important documents before terminating your account. We will provide a means for you to retrieve your data for a period (as specified in our Terms or upon request), after which we may delete your user data from our systems in line with our data retention policy and Privacy Policy. Note: If you have paid for a subscription, termination may be subject to our refund or cancellation policy as stated in the Terms of Service (e.g., there may be no refunds for unused subscription periods unless required by law).
Your Responsibilities as a User
Lawful and Appropriate Use: You are responsible for using Riskify only for lawful purposes and in a professional manner consistent with the platform’s intended use . This means you agree not to use the service for any activity that is illegal, unethical, or violates any applicable law or regulation. All SWMS you generate should be for legitimate workplace safety planning and compliance. You must not rely on Riskify for any use that is outside the scope of workplace safety documentation or that would violate Australian WHS laws or other laws. Using Riskify to generate false, misleading, or fraudulent documents is strictly prohibited. You also must ensure that your use complies with any industry-specific regulations that apply to you (for example, if you are in a regulated trade, you must still meet any accreditation or licensing requirements independently of what the software provides).
Provide Accurate and Relevant Information: You are responsible for the accuracy and truthfulness of the information you input into the Riskify platform. The quality and compliance of the generated SWMS depend on the details you provide about the job, site, hazards, and controls. You must not input data that is knowingly false, exaggerated, or misleading. Providing incorrect or incomplete information could result in an SWMS that is unsafe or non-compliant. You agree to use your professional judgment to input relevant facts (such as the nature of work, equipment, substances, site conditions, and safety measures) and to review the output for correctness. If the platform suggests information that does not apply to your situation, you are responsible for identifying and correcting it. Do not include any sensitive personal information that is not necessary for safety planning. If personal data (e.g., worker names, licences) is included, you must have any required consent to use that data.
Review and Verify Output: You have a responsibility to carefully review each SWMS or document generated by Riskify before using it in the field or relying on it. While Riskify leverages OpenAI’s GPT to draft content, AI-generated output may not always be accurate, complete, or up-to-date . Do not treat the generated SWMS as automatically compliant or tailored perfectly to your situation without verification. You must check the output for any errors, omissions, or inappropriate recommendations. Ensure that all hazards relevant to your job are addressed and that the control measures meet legal and best-practice standards. If the AI output contains any obviously incorrect or unsafe advice, it is your responsibility to reject or correct it. Remember that Riskify’s service is an aid and does not replace your professional judgment or legal duties to maintain a safe workplace. In short: you must evaluate and, if necessary, edit the AI-generated SWMS to ensure it is accurate and suitable before implementing it.
Compliance with Our Policies: You agree to adhere to all Riskify policies that apply to users, including this End User Rights & Responsibilities document, our [Terms of Service](link to Terms) and our [Acceptable Use Policy](link to AUP). This means following any rules or guidelines in those documents when using the platform. For example, if the Terms of Service set out age restrictions or export control restrictions, you must comply with them. If we update our policies and notify you, you are responsible for reviewing those changes and using the service in accordance with the updated requirements. Ignorance of the policies is not an excuse for non-compliance. If you have questions about any policy, it is your responsibility to seek clarification from Riskify or to discontinue use of the service.
Account Security and Authorized Use: You are responsible for maintaining the confidentiality and security of your Riskify account credentials (username and password, or any API keys/tokens if provided). Do not share your login details with any unauthorised person. If your subscription is meant for a single user or a specified number of seats/users, you must not exceed those authorised users. Ensure that only your employees or agents who are authorised and bound by these same obligations can access the platform under your account. You must promptly notify Riskify if you suspect any unauthorised access to or use of your account. Any activity that occurs under your account credentials will be deemed to be your actions, so it is in your interest to control access. You are also responsible for using secure devices and networks when accessing Riskify, to avoid introducing malware or otherwise compromising the platform’s security.
Use for Intended Purpose (No Misuse): You must use Riskify only for its intended purpose of creating SWMS and related safety documentation. Do not attempt to use the platform to generate unrelated content or for purposes outside of workplace safety/work method statements. Additionally, you must not misuse or interfere with the platform’s normal functioning. This includes refraining from any attempts to hack the service, introduce malicious code, or circumvent any technical controls or limits. You should not automate excessive requests to the service (for instance, via scripts or bots) beyond what is permitted, as that could degrade service performance. In summary,you are expected to use the service responsibly and refrain from any conduct that could harm the platform or others (see the Acceptable Use Policy for specific prohibitions).
Respect for Intellectual Property: You have a responsibility to respect Riskify’s intellectual property and the intellectual property rights of others when using the platform. This means you must not copy, distribute, or modify Riskify’s software, datasets, or templates except as allowed for your use of the service. Do not attempt to reverse engineer or extract the source code or underlying models of the platform. You should not remove or obscure any copyright, trademark, or proprietary notices on the platform or in generated templates. Moreover, you must not upload or input any material to Riskify that infringes the copyright, trademark, trade secret, or other intellectual property rights of any person or entity . For example, if you upload reference text or attach documents for context, you must have the right to use that material. Riskify expects users to only use content they are authorised to use. If you violate others’ IP rights, you could face legal consequences and your account may be suspended.
Payment and Subscription Obligations: If you have a paid subscription, you are responsible for timely payment of all fees according to the subscription plan you selected. Ensure that your billing information is accurate and updated. If payments are by invoicing, pay within the stated timeframe. Failure to pay subscription or usage fees when due may result in suspension of your access or termination of your account, as well as potential late fees as described in our Terms of Service. You are also responsible for any taxes or charges (if applicable) associated with your subscription, aside from taxes on Riskify’s income. If you dispute a charge, you must raise it in good faith and cooperate with us to resolve it. Note: Using the service beyond the scope of your subscription (for example, exceeding user limits or generating an excessive number of documents not covered by your plan) may result in additional fees per our Terms, so please use the service within your plan’s allowances.
Moderation and Reporting: While using the platform, if you encounter any content or behavior that you believe violates our Acceptable Use Policy or these responsibilities (for instance, if you receive an output that contains inappropriate content or notice another user attempting something malicious), you should report it to Riskify. We provide mechanisms to flag or report problematic content. You have a responsibility not to misuse these reporting tools (only report genuine issues). Additionally, if our automated systems flag your input or output as potentially violating the rules (e.g. containing disallowed content), you must cooperate in good faith with any requests from Riskify for clarification or take corrective action (such as editing the input). Remember that Riskify does notextensively monitor user content proactively, so we rely on users to behave responsibly and alert us to any serious issues.
Under the Work Health and Safety Act 2011 (Cth) and equivalent state and territory laws, the Person Conducting a Business or Undertaking (PCBU) retains a non-delegable duty to ensure the health and safety of workers and others in the workplace. Use of the Platform does not transfer, reduce, or otherwise affect these statutory duties. The Platform is a supplementary administrative tool only; all compliance, monitoring, and enforcement obligations remain the sole responsibility of the user.
Breach of Responsibilities: If you fail to meet the above responsibilities, it may constitute a breach of our Terms of Service and this policy. This can result in consequences including suspension or termination of your access to Riskify’s services, removal of any offending content, and/or other legal remedies or actions as appropriate. For example, providing false information or using the platform for illegal purposes can lead to immediate account termination without refund. Serious violations (such as attempts to hack the system or distribute illegal material) may be reported to law enforcement authorities. We will endeavour to notify you of minor or remediable breaches and may give you an opportunity to rectify the issue, but for serious or repeated breaches we reserve the right to take action without prior notice to protect the platform and other users. You may also be liable for any losses or damages suffered by Riskify or others due to your breach (subject to limitations of liability in our Terms).
